  1. Payment: Full payment is due by the second (2) business day after the close of auction.

    Methods of Payment:
    - Cash (All cash transactions must take place at our corporate office - 3750 Woodruff Road, Columbus, GA 31904).
    - Wire transfers are accepted. For wire transfer information, please contact us at 706-324-0344.
    - Credit cards (Visa, MasterCard, Discover Card & American Express) will be accepted only upon completion of an Evans Auctioneers, Inc.'s Credit Card Authorization Form available on our website (www.evansauction.com)

    NO Checks, Cashier Checks or Money Orders accepted.

    In the event the purchaser fails to pay for the entire purchase within the time set forth by the auctioneer, and/or fails to comply with any of the conditions or terms of sale, the seller may retain and/or recover any monies paid as part of its damages and, in addition thereto, items that are not paid for can be resold at public or private sale without further notice. Any deficiency resulting from such resale shall be due to the auctioneer by the defaulting purchaser together with all charges, fees, and expenses including reasonable attorney fees incurred by such resale and enforcement of the obligation hereunder.

     

  2. Auction bidders must register with a valid credit card with a current credit card billing address and driver’s license.
     

  3. As-Is & Where Is: While descriptions are believed to be accurate, the auctioneer and seller make no warranties or guarantees, expressed or implied. Evans Auctioneers, Inc. will not be held responsible for any advertising discrepancies or inaccuracies. Everything is sold “AS-IS” and “WHERE-IS” except as expressly made in writing. No warranties are made as to the merchantability of any items or their fitness for any purpose. ALL SALES ARE FINAL.

    Purchaser does hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal or shipping of items purchased.

     

  4. Removal: It is the buyer’s sole responsibility for the removal and shipping of the equipment and inventory and must supply their own handling of equipment and personnel. The buyer must repair/replace any damage that occurs during removal. It is the buyer’s responsibility to secure all safety equipment to meet all applicable government safety standards in using or removing items purchased. Shipping may be arranged at additional cost to buyer.

    No item can, on any account, be removed or shipped prior to full payment. Removal shall be at the expense, risk, and liability of the purchaser. Auctioneers shall not be responsible for items not removed within the time allowed when applicable. If items are not removed within the specified removal time, the purchaser shall be liable for any moving and/or storage costs incurred and, if not so removed, the items shall be deemed abandoned and sold. The purchaser will have two (2) weeks after the auction closes in order to remove the items purchased.

    The seller and auctioneer shall have no liability to the buyer of any lot for non-delivery or any purchased item(s), other than the buyer’s deposit or payment on the lot.

  5. Quantity: If any shortages exist on counts, an adjustment will be made only if claims are made at the time of removal. No adjustments as to counts will be allowed after purchased item(s) are removed from the premises.
     

  6. Buyer’s Premium: 13.5% Buyer’s Premium will be added to all purchases.
     

  7. Sales Tax and TAVT: Local Georgia sales tax rate of 9% will be added to the purchase of all taxable items sold. Residents outside of Georgia will be tax exempt on vehicle purchases only. If a Georgia resident purchases a vehicle, they will be charged the Title Ad Valorem Tax (TAVT) established by The State of Georgia. For more information on TAVT, visit The State of Georgia Website at: https://dor.georgia.gov/motor-vehicles/vehicle-taxes-title-ad-valorem-tax-tavt-and-annual-ad-valorem-tax. Anyone who will purchase for resale or who are tax exempt, must forward their resale permit numbers to Evans Auctioneers prior to payment.
     

  8. Georgia Vehicle Emissions: NO vehicles included in our online auctions have been tested for vehicle emissions. By Georgia Law, any vehicle that does not have a current valid passing emissions test certificate, CAN NOT and WILL NOT be sold to an Individual living in an emissions county. Vehicle emission testing is required annually in the 13 metro Atlanta counties in Georgia (Cherokee, Clayton, Cobb, Coweta, DeKalb, Douglas, Fayette, Forsyth, Fulton, Gwinnett, Henry, Paulding and Rockdale Counties) in order to complete their vehicle registration. THIS DOES NOT APPLY TO GEORGIA VEHICLE DEALERS. It is the bidder’s responsibility to know the county requirements for purchasing and registering vehicles for which they reside.   9. Georgia Electronic Title Registration (ETR): ALL NON-VEHICLE DEALER GEORGIA RESIDENTS WILL BE NEED TO FILL OUT THE REQUIRED ETR PAPERWORK AT OUR MAIN HEADQUARTERS LOCATED AT 3750 WOODRUFF ROAD, COLUMBUS, GA 31904 IMMEDIATELY AFTER PURCHASE.

    By Georgia law, Evans Auctioneers, Inc. is required to electronically transfer vehicle titles for all Georgia residents at the time of purchase. The vehicle title will be registered in the name & address used at the time of registration. A copy of the purchaser’s valid Georgia drivers’ license will be required at the time payment is received. NO EXCEPTIONS. $50.00 Shipping and Handling Fee will be applied per each electronically transferred title.

    New Georgia Residents without a valid Georgia ID: In order to be considered a Georgia Resident without a valid Georgia Driver’s License, you must supply us with at least two of the following forms of identification: 1) Government-issued photo ID; 2) Residential Lease/Property Deed; 3) Utility Bill; 4) Letter from the government/court (marriage license, divorce, government aid); 5) Bank statement; 6) Driver’s License or Learner’s Permit; 7) Car Registration; 8) Notarized affidavit of residency.
